If you terminate your employee before the end of the expiration date of the authorized stay for H-1B, please be aware of the following.  The federal law requires the employer to (1) notify the Department of Homeland Security that the employment relationship has been terminated so that the petition is canceled, and (2) provide the H-1B employee with payment for transportation home. If you fail to follow the above requirements, your company will be found responsible for paying the required wage for your employee until the expiration of his or her authorized period of stay for H-1B employment.
